Sa. 205-207A of the P.H. & B.O. has to be restricted to a limitad152

portion of a building, such as a 'party wall', 'front wall', &c. It

rarely happens that an entire building has to be condemed as

dangerous or even sufficient of it to necessitate ita re-construct-

-ion as a "new building".

Having regard to all the circumstances of the case,

I am of opinion that the best course would be to enact that every building erected prior to the passing of the Buildings Ordinance, 1889, should, within 40 years from the date of the passing of the

said Ordinance, (2nd May, 1889), be made to comply with the provi-

-aions of the P. H. & B. 0., 1903, relating to "New Buildings". I

would further submit that every building erected between the 2nd

May, 1889, and the 21st February, 1903, including every building

the erection of which was begun prior to the last-mentioned dute,

should, within 50 years from the said last-mentioned date, (21st

February, 1903), be altered to comply with the provisions of the P.

H. & E. 0., 1903, relating to 'New Buildings'.

In legislating on the lines indicated, it would

be necessary to confer ample powers of modification or exemption

upon the Building Authority. I would point out that owers of pm- -perty have a right of appeal to the Governor-in-Council against any decision of the Building Authority (Vide S. 265 of the P.H. & B.0.).

Spanking generally, the provisions of the existing

P. H. & B. O. with regard to "New Buildings' are adequate and a vast

improvement would result from the adoption of the course I have suggested. It is however advisable that the provision with regard

to the height of buildings should be strengthened.

Under S. 189 (1) "the height of any building *shall be determined by measuring on the line of the main walls "both back and front) from the level of the street on which the "principal front of such building abute the full vertical heights "allowed by the foregoing section------". Unless therefore, a building 'abuts' on a street, there is no control over its height. By setting back from the street, to a small extent, the front of his building, an owner may avade compliance with the requirements of the
